ТЕОРЕТИЧНІ ЗАСАДИ АНТИКОРУПЦІЙНОЇ ПОЛІТИКИ ЄС: ІСТОРИЧНИЙ РОЗВИТОК МЕХАНІЗМІВ ДОБРОЧЕСНОСТІ

Стаття присвячена комплексному аналізу теоретичних засад, історичної еволюції та сучасної архітектури антикорупційної політики Європейського Союзу. У роботі досліджено трансформацію підходів ЄС від реактивних механізмів фінансового контролю до всеосяжної парадигми «публічної доброчесності», що базується на принципах належного врядування. Особливу увагу приділено інституційному дуалізму між адміністративними розслідуваннями OLAF та кримінальним переслідуванням з боку Європейської прокуратури (EPPO). Авторами проаналізовано принципи відкритості, підзвітності та участі як нормативні орієнтири для розбудови довіри громадян до європейських інституцій.
Дослідження охоплює історичний шлях розвитку антикорупційної інфраструктури, починаючи від системної кризи Комісії Сантера 1999 року, яка стала каталізатором радикальних реформ. Розглянуто роль теорії «принципал-агент» в обґрунтуванні необхідності наглядових органів для подолання асиметрії інформації в багаторівневому врядуванні. Окремо висвітлено еволюцію механізмів «м’якого права», зокрема перехід Реєстру прозорості від добровільної до фактично обов'язкової моделі лобіювання. Проаналізовано вплив Директиви PIF на гармонізацію кримінального законодавства держав-членів щодо боротьби з шахрайством та корупцією. Значну увагу приділено новітнім ініціативам, таким як Директива про захист викривачів та дискусійний проект створення єдиного Міжінституційного етичного органу ЄС.
У контексті євроінтеграції України наголошено на важливості адаптації європейських стандартів не лише через технічну рецепцію норм, а й через формування культури доброчесного лідерства. Стаття підкреслює, що інтеграція України в європейський антикорупційний простір через взаємодію з OLAF та EPPO є ключовим драйвером прозорості повоєнної відбудови. Зроблено висновок, що синергія інституційної стійкості ЄС та реформаторських зусиль України є необхідною умовою для створення єдиного безпекового та правового простору, вільного від системної корупції.
